Woman gets ticket for wearing Google Glass while driving

Wed Oct 30, 2013 11:32 pm

Looks to me like local Police officers want to make up laws at their fancy. Who do they think they are, the NSA or something?

After a bit more research it looks like the woman was originally pulled over for speeding. Apparently, it's illegal in California to use a HUD in a moving vehicle unless it came as original equipment on that vehicle. Hence the ticket for the wearing the Google Glass headset. Still, I think the officer is reaching here trying to classify the Google Glass as a HUD. There is no mention if the Glass headset was even turned on. Could the officer tell if it was? Just the fact the woman had it on her head seems to have offended the officer.

Not that I agree with the charge, but if it's in her line of vision, and it hasn't passed DOT testing like an OEM HUD would, it makes sense, and seems to follow the law.

Now, if they made Google Glass into actual glasses, so that you couldn't really tell...

This is the original story, with a copy of ticket:

She can easily get that violation dismissed (Google Glass does not impede your view when turned off and navigation devices are not illegal for use in vehicles) but there is also a speeding violation on same ticket, which was most likely the primary reason her car was stopped...

This is the relevant law:

Notice that the exception is only for GPS devices, etc. that are "installed" in the vehicle. Seems like an ambiguous area of the law.
