Ford sends cease-and-desist to GM over Super Bowl ad

Mon Feb 06, 2012 1:16 pm

Ford is POed that GM implied Ford's pickup trucks won't survive the apocalypse.

W...T...F?!??

Guess one of Ford's lawyers was really bored and looking for something to do...

After the Apocalypse there will be an easy way to solve such problems.

Don't worry about breaking the rules; there aren't any.

I think there's some sort of unwritten rule in advertising, that you never mention your competitor by name. Even those commercials during the Super Bowl that were making fun of the iPhone never showed an iPhone or explicitly said "iPhone" or "Apple."

That lawsuit is kinda ridiculous, but I did think that explicitly mentioning a Ford was somewhat a bad taste (most Ads don't do that when implying that their competitor's product is inferior).

Ford just needs to retaliate by making a commercial citing the fact that their name isnt Government Motors and that they didnt take an TARP hand outs.

Ford should've just made their private presentations/videos like these: http://www.youtube.com/watch?v=EWjTbiYo3x0 into a public TV Ads

Tell that to Coke and Pepsi.

It's true a lot of advertising doesn't mention competitors by name ("vs a leading brand" etc) but that's usually because the rule is "don't give free advertising to your competitors." (This can be taken to insane degrees, too: in the old days when IBM made photocopiers, IBM employees could receive a formal reprimand for using the word "Xerox" as a verb). It's possible that not mentioning a specific competitor might give you some wiggle room in the event the claims for your product (or theirs) proved not to be true (misleading? advertising? really?) but I don't think that's the primary motivation for avoiding specific mentions. After all, if it came to a lawsuit in a situation where the legal "reasonable person" can infer who the unnamed competitor is, leaving them unnamed in the ad doesn't provide much legal cover.

And let's not be dishonest: Ford has taken public money before to stay afloat, and they will again if they feel its in their best interests to do so.

I'm sure we're in R&P territory now, oh well.

a much better response would be to come out with an ad about why the chevy owners are all left behind.. while all the Ford Saints were raptured.

So I wonder which way Hostess Brands will go on this one, assuming the bankruptcy court allows them to pursue an action.

Pretty much the first thing I thought after seeing that cream-filled cake snacks will survive the nuclear apocalypse was "Silly customer! You cannot hurt the Twinkie!"

...turns out, Ford didn't really need to threaten the GM; they got better sales possibly because of this Ad and should instead send GM teh cake or something.

The article doesn't say anything about sales increasing. Just that more people were visiting the Ford web site.

I think Ford needs to stop acting so precious, whoopdie-do maybe they should just counter with an equally smart-arse style ad?

Not Ford's website - KBB's website. Anyway, it is obvious that only Ford and GM themselves have access to the actual sales data (from their dealers) and obviously they will never share that (they only share yearly sales), so the only way you can openly approximate how "effective" Ad was is to measure the potential customer's "interest" in particular model by measuring how many of them were using "research tools" on sites like KBB or Edmunds or similar ones.

Or people were looking to sell their Ford trucks...

I don't believe either company's trucks will survive the apocalypse, since there will be no more fuel refined and no more spare parts made beyond that point.

There will be plenty of gas and spare parts. Just scavenge from all the wrecked and abandoned vehicles.
